  1. The  Windows 95 Infrared Support  software which you have
  2. downloaded for use only with Microsoft Windows operating
  3. system software is considered part of such Microsoft Windows
  4. operating system software.  Therefore, its use is subject to
  5. the same terms and conditions governing use of Microsoft
  6. Windows operating system.  Such terms and conditions are
  7. reprinted below for your convenience.

  9. Windows « 95  END-USER LICENSE AGREEMENT FOR MICROSOFT
  10. SOFTWARE
  11.  
  12. IMPORTANT READ CAREFULLY: This Microsoft End-User License
  13. Agreement (EULA) is a legal agreement between you (either
  14. an individual or a single entity) and Microsoft Corporation
  15. for the Microsoft software product identified above, which
  16. includes computer software and associated media and printed
  17. materials, and may include online or electronic
  18. documentation (SOFTWARE PRODUCT or SOFTWARE).  By
  19. installing, copying or otherwise using the SOFTWARE PRODUCT,
  20. you agree to be bound by the terms of this EULA.  If you do
  21. not agree to the terms of this EULA, promptly return the
  22. unused SOFTWARE PRODUCT to the place from which you obtained
  23. it for a full refund.
  24.  
  25. Software PRODUCT LICENSE
  26.  
  27. The SOFTWARE PRODUCT is protected by copyright laws and
  28. international copyright treaties, as well as other
  29. intellectual property laws and treaties.  The SOFTWARE
  30. PRODUCT is licensed, not sold.
  31.  
  32. 1.  GRANT OF LICENSE.  This EULA grants you the following
  33. rights:
  34.  
  35.   Systems Software.  You may install and use one copy of the
  36. SOFTWARE PRODUCT on a single computer.  If the SOFTWARE
  37. PRODUCT includes functionality that enables your single
  38. computer to act as a network server, any number of computers
  39. or workstations may access or otherwise utilize the basic
  40. network services of that server.  The basic network services
  41. are more fully described in the printed materials
  42. accompanying the SOFTWARE PRODUCT.
  43.  
  44.   Storage/Network Use.  You may also store or install a copy
  45. of the SOFTWARE PRODUCT on a storage device, such as a
  46. network server, used only to install or run the SOFTWARE
  47. PRODUCT on your other computers over an internal network;
  48. however, you must acquire and dedicate a license for each
  49. separate computer on which the SOFTWARE PRODUCT is installed
  50. or run from the storage device.  A license for the SOFTWARE
  51. PRODUCT may not be shared or used concurrently on different
  52. computers.
  53.  
  54.   Programming Language Software.  If the SOFTWARE PRODUCT is
  55. a Microsoft programming language product, then you have a
  56. royalty-free right to reproduce and distribute executable
  57. files created using the SOFTWARE PRODUCT.  If the
  58. programming language product is a Basic or COBOL product,
  59. then Microsoft grants you a royalty-free right to reproduce
  60. and distribute the run-time modules of the SOFTWARE PRODUCT,
  61. provided that you:  (a) distribute the run-time modules only
  62. in conjunction with and as a part of your software product;
  63. (b) do not use Microsoft Corporation's name, logo, or
  64. trademark to market your software product; (c) include a
  65. valid copyright notice on your software product; and (d)
  66. agree to indemnify, hold harmless, and defend Microsoft
  67. Corporation, its suppliers and distributors from and against
  68. any claims or lawsuits, including attorneysÆ fees, that
  69. arise or result from the use or distribution of your
  70. software product.  The run-time modules are those files in
  71. the SOFTWARE PRODUCT that are identified in the accompanying
  72. printed materials as required during execution of your
  73. software program.  The run-time modules are limited to run-
  74. time files, and ISAM and REBUILD files.  If required in the
  75. printed material accompanying the SOFTWARE PRODUCT, you
  76. agree to display the designated patent notices on the
  77. packaging and in the README file of your software product.
  78.  
  79.   License Pak.  If you have acquired this EULA in a
  80. Microsoft License Pak, you may make the number of additional
  81. copies of the computer software portion of the SOFTWARE
  82. PRODUCT authorized on the printed copy of this EULA, and you
  83. may use each copy in the manner specified above.
  84.  
  85. 2.  DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
  86.  
  87.   Limitations on Reverse Engineering, Decompilation and
  88. Disassembly.  You may not reverse engineer, decompile, or
  89. disassemble the SOFTWARE PRODUCT, except and only to the
  90. extent that such activity is expressly permitted by
  91. applicable law notwithstanding this limitation.
  92.  
  93.   Separation of Components.  The SOFTWARE PRODUCT is
  94. licensed as a single product.  Its component parts may not
  95. be separated for use on more than one computer.
  96.  
  97.   Single Machine.  The SOFTWARE PRODUCT may only be used
  98. with the single computer on which it was first installed.
  99.  
  100.   Rental.  You may not rent or lease the SOFTWARE PRODUCT.
  101.  
  102.   Systems Software Transfer.  You may permanently transfer
  103. all of your rights under this EULA only as part of a sale or
  104. transfer of your single computer system where the SOFTWARE
  105. PRODUCT is installed, provided you retain no copies, you
  106. transfer all of the SOFTWARE PRODUCT (including all
  107. component parts, the media and printed materials, any
  108. upgrades, this EULA and, if applicable, the Certificate of
  109. Authenticity), and the recipient agrees to the terms of this
  110. EULA.  If the SOFTWARE PRODUCT is an upgrade, any transfer
  111. must include all prior versions of the SOFTWARE PRODUCT.
  112.  
  113.   Termination.  Without prejudice to any other rights,
  114. Microsoft may terminate this EULA if you fail to comply with
  115. the terms and conditions of this EULA.  In such event, you
  116. must destroy all copies of the SOFTWARE PRODUCT and all of
  117. its component parts.
  118.  
  119. 3.  UPGRADES.  If the SOFTWARE PRODUCT is an upgrade from
  120. another product, whether from Microsoft or another supplier,
  121. you may use or transfer the SOFTWARE PRODUCT only in
  122. conjunction with that upgraded product, unless you destroy
  123. the upgraded product.  If the SOFTWARE PRODUCT is an upgrade
  124. of a Microsoft product, you now may use that upgraded
  125. product only in accordance with this EULA.  If the SOFTWARE
  126. PRODUCT is an upgrade of a component of a package of
  127. software programs which you licensed as a single product,
  128. the SOFTWARE PRODUCT may be used and transferred only as
  129. part of that single product package and may not be separated
  130. for use on more than one computer.
  131.  
  132. 4.  COPYRIGHT.  All title and copyrights in and to the
  133. SOFTWARE PRODUCT (including but not limited to any images,
  134. photographs, animations, video, audio, music, text and
  135. applets, incorporated into the SOFTWARE PRODUCT), the
  136. accompanying printed materials, and any copies of the
  137. SOFTWARE PRODUCT, are owned by Microsoft or its suppliers.
  138. The SOFTWARE PRODUCT is protected by copyright laws and
  139. international treaty provisions. Therefore, you must treat
  140. the SOFTWARE PRODUCT like any other copyrighted material
  141. except that you may either (a) make one copy of the SOFTWARE
  142. PRODUCT solely for backup or archival purposes, or
  143. (b) install the SOFTWARE PRODUCT on a single computer
  144. provided you keep the original solely for backup or archival
  145. purposes.  You may not copy the printed materials
  146. accompanying the SOFTWARE PRODUCT.
  147.  
  148. 5.  DUAL-MEDIA SOFTWARE.  You may receive the SOFTWARE
  149. PRODUCT in more than one medium. Regardless of the type or
  150. size of medium you receive, you may use only one medium that
  151. is appropriate for your single computer.  You may not use or
  152. install the other medium on another computer.  You may not
  153. loan, rent, lease, or otherwise transfer the other medium to
  154. another user, except as part of the permanent transfer (as
  155. provided above) of the SOFTWARE PRODUCT.
  156.  
  157. 6.  U.S. GOVERNMENT RESTRICTED RIGHTS.  The SOFTWARE PRODUCT
  158. and documentation are provided with RESTRICTED RIGHTS.  Use,
  159. duplication, or disclosure by the Government is subject to
  160. restrictions as set forth in subparagraph (c)(1)(ii) of the
  161. Rights in Technical Data and Computer Software clause at
  162. DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the
  163. Commercial Computer Software Restricted Rights at 48 CFR
  164. 52.227-19, as applicable. Manufacturer is Microsoft
  165. Corporation/One Microsoft Way/Redmond, WA 98052-6399.

  167. MISCELLANEOUS
  168.  
  169. If you acquired this product in the United States, this EULA
  170. is governed by the laws of the State of Washington.
  171.  
  172. If you acquired this product in Canada, this EULA is
  173. governed by the laws of the Province of Ontario, Canada.
  174. Each of the parties hereto irrevocably attorns to the
  175. jurisdiction of the courts of the Province of Ontario and
  176. further agrees to commence any litigation which may arise
  177. hereunder in the courts located in the Judicial District of
  178. York, Province of Ontario.
  179.  
  180. If this product was acquired outside the United States, then
  181. local law may apply.
  182.

  189. LIMITED WARRANTY
  190.  
  191. LIMITED WARRANTY.  Microsoft warrants that (a) the SOFTWARE
  192. PRODUCT will perform substantially in accordance with the
  193. accompanying written materials for a period of ninety (90)
  194. days from the date of receipt, and (b) any hardware
  195. accompanying the SOFTWARE PRODUCT will be free from defects
  196. in materials and workmanship under normal use and service
  197. for a period of one (1) year from the date of receipt.  Some
  198. states and jurisdictions do not allow limitations on
  199. duration of an implied warranty, so the above limitation may
  200. not apply to you.  To the extent allowed by applicable law,
  201. implied warranties on the SOFTWARE PRODUCT and hardware, if
  202. any, are limited to ninety (90) days and one year,
  203. respectively.
  204.  
  205. CUSTOMER REMEDIES.  MicrosoftÆs and its suppliersÆ entire
  206. liability and your exclusive remedy shall be, at MicrosoftÆs
  207. option, either (a) return of the price paid, or (b) repair
  208. or replacement of the SOFTWARE PRODUCT or hardware that does
  209. not meet MicrosoftÆs Limited Warranty and which is returned
  210. to Microsoft with a copy of your receipt.  This Limited
  211. Warranty is void if failure of the SOFTWARE PRODUCT or
  212. hardware has resulted from accident, abuse, or
  213. misapplication.  Any replacement SOFTWARE PRODUCT or
  214. hardware will be warranted for the remainder of the original
  215. warranty period or thirty (30) days, whichever is longer.
  216. Outside the United States, neither these remedies nor any
  217. product support services offered by Microsoft are available
  218. without proof of purchase from an authorized international
  219. source.
  220.  
  221. NO OTHER WARRANTIES.  TO THE MAXIMUM EXTENT PERMITTED BY
  222. APPLICABLE LAW, MICROSOFT AND ITS SUPPLIERS DISCLAIM ALL
  223. OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT
  224. NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND
  225. FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE
  226. SOFTWARE PRODUCT, AND ANY ACCOMPANYING HARDWARE.  THIS
  227. LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS.  YOU MAY
  228. HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO
  229. STATE/JURISDICTION.
  230. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  TO THE MAXIMUM
  231. EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL
  232. MICROSOFT OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL,
  233. INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER
  234. (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS
  235. PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS
  236. INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE
  237. USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF
  238. MICROSOFT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  239. DAMAGES.  BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW
  240. THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL
  241. OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO
  242. YOU.
